These Terms of Service ("Terms") govern your access to and use of the CalledItAI website, dashboard, software, phone workflows, automations, analytics, and related services (the "Services") provided by CalledItAI LLC, a New Jersey limited liability company ("CalledItAI," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You represent that you are at least 18 years old and have the authority to bind yourself or the business using the Services.

Services

CalledItAI provides software tools designed to help businesses capture and manage inbound customer interactions, including AI-assisted call handling, call routing, transcripts, summaries, booking workflows, intake collection, analytics, notifications, and related automation.

The Services may include business dashboards, phone numbers, call forwarding instructions, calendar integrations, SMS notifications, third-party payment flows, and other operational tools. We may modify, improve, suspend, or discontinue portions of the Services at any time.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and promptly notify us of any suspected unauthorized access.

You are responsible for ensuring that each user you invite or authorize has permission to access your business information, call data, dashboard, integrations, and billing information.

Customer Responsibilities

You are responsible for:

• the content and legality of your business information, settings, scripts, menus, services, provider data, and workflows;
• obtaining any notices or consents required for call recording, transcription, messaging, AI assistance, and appointment workflows;
• complying with applicable privacy, call recording, telemarketing, text messaging, consumer protection, professional licensing, and industry-specific laws;
• confirming that any phone number, forwarding setup, website copy, offer, discount, pricing, menu, service area, or booking rule you provide is accurate and lawful; and
• reviewing AI-generated outputs before relying on them in situations where human review is appropriate.

No Professional Advice

CalledItAI is a software platform. We do not provide legal, medical, financial, or other licensed professional advice. Any outputs generated through the Services are for informational and operational purposes only.

The Services are not designed for emergency dispatch, emergency medical services, crisis response, or situations where a failure or delay could cause physical harm. You should maintain appropriate human backup and escalation procedures for your business.

Billing and Renewals

CalledItAI does not offer a self-serve free trial. Billing begins when you complete the paid checkout flow for your selected plan.

Unless otherwise stated:

• subscriptions renew automatically until canceled;
• you authorize recurring charges using your selected payment method;
• subscription fees are non-refundable once billing begins, except where required by law; and
• taxes may be added where applicable.

Plans may include usage limits, feature limits, call volume limits, automation limits, or tier-specific features. If your usage exceeds your plan limits, we may require you to upgrade, pay applicable usage charges, or reduce usage.

Acceptable Use

You may not use the Services to violate the law, infringe others' rights, send unlawful or abusive communications, misrepresent your business, send spam, make deceptive calls or messages, collect sensitive information unlawfully, disrupt the Services, gain unauthorized access, or create unreasonable security, legal, or operational risk.

Third-Party Services

The Services may integrate with third-party providers such as Twilio, Google, OpenAI, Stripe, and Wix. We are not responsible for the availability or performance of third-party services.

Your use of third-party integrations may also be governed by those providers' terms, privacy policies, usage rules, and fees.

Intellectual Property

CalledItAI and its software, branding, features, content, and technology are owned by us or our licensors and are protected by applicable law. We grant you a limited, non-exclusive, revocable right to use the Services for your internal business purposes during an active subscription term.

Customer Data

As between you and CalledItAI, you retain rights to the content and data you submit to the Services. You grant us the rights reasonably necessary to host, process, transmit, analyze, store, and display that data in order to provide and improve the Services.

AI Outputs and Availability

The Services rely in part on automated systems and third-party providers. AI-generated outputs may be incomplete, inaccurate, or unsuitable in some situations. We do not guarantee uninterrupted, error-free, or always-available service.

You are responsible for reviewing important outputs, maintaining accurate business settings, and deciding when human review, correction, or follow-up is needed.

Phone Numbers, Calls, and Messaging

If the Services provision, display, or help configure phone numbers, call forwarding, SMS alerts, or related communications, you are responsible for confirming that your setup works correctly and complies with laws that apply to your business and callers. We do not guarantee that every call, message, booking request, alert, or notification will be received, answered, transcribed, routed, or delivered.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLEDITAI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to defend, indemnify, and hold harmless CalledItAI and its affiliates, officers, directors, employees, contractors, and licensors from and against claims, losses, liabilities, and expenses arising out of your use of the Services, your data or content, your violation of these Terms, or your violation of applicable law.

Suspension and Termination

We may suspend or terminate access to the Services if you violate these Terms, fail to pay, create security or legal risk, or if we are required to do so by law.

After termination, your access to the Services may stop, but certain provisions of these Terms will continue to apply, including payment obligations, intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, unless otherwise required by law or agreed in writing.

Disputes

Before filing a claim, you agree to contact us and try to resolve the dispute informally. If a dispute cannot be resolved informally, the state or federal courts located in New Jersey will have jurisdiction, unless applicable law requires a different forum.

Changes to These Terms

We may update these Terms from time to time. If we do, we will revise the "Last Updated" date and post the updated version.
